Agreement to Terms

These Terms of Service ("Terms") constitute a legally binding agreement between you ("Client") and Empire Platinum ("Company," "we," "us," or "our") governing your access to and use of our luxury concierge and lifestyle management services, as well as our website.

By requesting services, executing a service agreement, or using our website, you confirm that you are at least 18 years of age, have the legal authority to enter into this agreement, and accept these Terms in full. If you do not accept these Terms, you may not use our services.

Services

Empire Platinum provides premium concierge and lifestyle management services in New York and beyond, including but not limited to:

• Private helicopter and ground transportation arrangements
• Armored vehicle and executive security transport
• Limousine and chauffeur services
• Private event planning and coordination
• Exclusive dining, restaurant, and nightlife reservations
• Sporting event, concert, and entertainment access
• Bespoke lifestyle and personal management services

All services are provided subject to availability and at the sole discretion of Empire Platinum. We reserve the right to decline service requests that conflict with our operational standards, legal obligations, or policies.

Service Requests and Bookings

Service requests may be submitted via our website, email, or telephone. All bookings are subject to confirmation by Empire Platinum. A booking is not confirmed until you receive written confirmation from us.

Clients are responsible for providing accurate, complete, and timely information necessary to fulfill service requests. Empire Platinum shall not be liable for service failures, delays, or additional costs arising from inaccurate or incomplete information provided by the Client.

Fees and Payment

Fees for services are as agreed in your individual service agreement or as quoted in writing prior to service delivery. All fees are stated in US dollars unless otherwise specified.

• Payment is due as specified in your service agreement or invoice
• We accept major credit cards, wire transfers, and other payment methods as agreed
• Late payments may be subject to interest charges at the rate of 1.5% per month
• All fees are exclusive of applicable taxes, gratuities, and third-party charges unless expressly stated

Retainer clients will be billed according to their individual retainer agreements, which supersede these general payment terms where they conflict.

Cancellation and Modifications

Cancellation and modification policies vary by service type and are specified in your individual service agreement. As a general policy:

• Cancellations made with less than 24 hours notice may incur a cancellation fee of up to 100% of the service cost
• Cancellations for bookings involving third-party vendors are subject to those vendors' cancellation policies
• Empire Platinum will make every reasonable effort to accommodate modifications to confirmed bookings, subject to availability and additional charges where applicable

Empire Platinum reserves the right to cancel any service arrangement due to circumstances beyond our control, including but not limited to severe weather, safety concerns, regulatory restrictions, or acts of God. In such cases, we will provide a full refund of any advance payments made for the affected service.

Limitation of Liability

Empire Platinum acts as an agent and coordinator in arranging many of the services provided to clients. We are not responsible for the acts, omissions, or negligence of third-party service providers, including transportation operators, venue operators, restaurants, or other vendors.

To the fullest extent permitted by applicable law, Empire Platinum's total liability to you for any claim arising from or related to our services shall not exceed the fees paid by you for the specific service giving rise to the claim in the three (3) months preceding the date of the claim.

We shall not be liable for any indirect, incidental, special, consequential, or punitive damages, regardless of the cause of action or the theory of liability.

Client Conduct

Clients are expected to conduct themselves with respect and courtesy toward Empire Platinum staff and all third-party service providers arranged on their behalf. Empire Platinum reserves the right to terminate service relationships with clients who engage in abusive, threatening, or unlawful conduct, without refund of any fees paid.

Intellectual Property

All content on the Empire Platinum website, including text, graphics, logos, images, and design elements, is the exclusive property of Empire Platinum and is protected by applicable copyright and trademark laws. Unauthorized reproduction, distribution, or use of our content is strictly prohibited.

Governing Law and Dispute Resolution

These Terms are governed by and construed in accordance with the laws of the State of New York, without regard to its conflict of law provisions. Any dispute arising from or relating to these Terms or our services shall be resolved by binding arbitration in New York County, New York, under the rules of the American Arbitration Association.

Modifications to These Terms

We reserve the right to modify these Terms at any time. We will notify active clients of material changes via email. Your continued use of our services following such notification constitutes your acceptance of the revised Terms.
